Welcome to TradeOp (“TradeOp”, “we”, “our”, or “us”). These Terms & Conditions govern your access to and use of the TradeOp platform, website and services.
By accessing or using TradeOp, you agree to be bound by these Terms. If you do not agree, you must not use our services.
1. About TradeOp
TradeOp provides AI-powered telephone answering, customer communication, workflow automation and messaging services designed for trade businesses.
Our services may utilise artificial intelligence, speech recognition, third-party messaging providers and cloud infrastructure to process communications and assist businesses with customer enquiries.
2. Eligibility
You confirm that you have the authority to enter into these Terms on behalf of yourself or the organisation you represent.
3. Use of the Service
You agree to use TradeOp only for lawful business purposes.
You must not:
- Use the service for unlawful activity.
- Attempt to interfere with the platform.
- Reverse engineer or copy the software.
- Transmit malicious software.
- Use the platform to harass or abuse others.
4. Customer Data
In providing our services, TradeOp may collect, process and store information including but not limited to:
- Customer names
- Telephone numbers
- Email addresses
- Property addresses
- Call recordings
- AI-generated call summaries
- Appointment details
- Messages
- Business information
- Usage analytics
This information is collected solely for the purpose of providing and improving the TradeOp service.
You confirm that you have all necessary rights and permissions to submit customer information to TradeOp.
5. Data Storage
Customer information may be securely stored using trusted third-party cloud infrastructure providers.
Data may be stored, processed and backed up in multiple geographic regions where necessary to provide reliable service.
We implement commercially reasonable security measures to protect customer information. However, no online service can guarantee absolute security.
6. AI Generated Content
TradeOp uses artificial intelligence to answer calls, transcribe conversations and generate summaries.
AI-generated information may occasionally contain inaccuracies.
You acknowledge that all AI outputs should be reviewed where appropriate before being relied upon for important business decisions.
TradeOp accepts no responsibility for losses arising from reliance upon AI-generated responses.
7. Third Party Services
TradeOp integrates with third-party providers including messaging, telephony, cloud hosting and artificial intelligence providers.
Availability of the service depends partly upon these third-party providers.
TradeOp is not responsible for outages, failures or delays caused by third-party services.
8. Service Availability
We aim to provide a reliable service but do not guarantee uninterrupted availability.
The service may occasionally be unavailable due to maintenance, upgrades, security events or circumstances beyond our control.
9. Fees
Subscription fees are payable in advance unless otherwise agreed.
Failure to make payment may result in suspension or termination of the service.
All fees are non-refundable unless required by law.
10. Fair Usage
All subscription plans are subject to a Fair Usage Policy.
Unless otherwise agreed in writing, each subscription includes up to 250 minutes of AI call handling per calendar month. This allowance includes all inbound calls processed by TradeOp’s AI services.
If your usage consistently exceeds the monthly allowance, we may:
contact you to discuss your usage;
recommend or require you to move to a more appropriate subscription plan;
apply additional usage charges where agreed in advance; or
temporarily limit access to the Service until the start of the next billing period.
Unused minutes do not roll over between billing periods. We reserve the right to amend the Fair Usage allowance upon providing reasonable notice where necessary to maintain the quality, availability, or commercial viability of the Service. Excessive or abusive use designed to circumvent these limits may result in suspension or termination of the Service.
11. Overage Charges
Each subscription includes the monthly AI call handling allowance specified for the applicable subscription plan.
Where a Customer exceeds the included monthly allowance, TradeOp may, at its discretion:
invoice the Customer for additional usage at the rates published on our website or otherwise notified to the Customer;
require the Customer to upgrade to a subscription plan more appropriate for their level of usage; or
temporarily suspend or limit AI call handling until the next billing period begins.
TradeOp will use reasonable efforts to notify the Customer before applying any overage charges where reasonably practicable. Continued use of the Service following notification constitutes acceptance of the applicable charges.
TradeOp reserves the right to amend included usage allowances and overage pricing by providing reasonable prior notice.
10. Intellectual Property
All software, branding, designs, logos, source code, documentation and intellectual property relating to TradeOp remain the exclusive property of TradeOp.
No ownership rights are transferred through use of the service.
12. Confidentiality
Both parties agree to keep confidential information received through use of the service confidential except where disclosure is required by law.
13. Limitation of Liability
To the fullest extent permitted by law, TradeOp shall not be liable for:
- Loss of revenue
- Loss of profit
- Loss of business opportunity
- Loss of data
- Business interruption
- Indirect or consequential damages
- Errors generated by artificial intelligence
- Missed telephone calls
- Incorrect appointment bookings
- Third-party service failures
TradeOp’s total aggregate liability arising out of or relating to the service shall not exceed the total subscription fees paid by the customer during the twelve (12) months immediately preceding the event giving rise to the claim.
14. Indemnity
You agree to indemnify and hold harmless TradeOp, its directors, employees and affiliates against any claims, damages, liabilities, losses or expenses arising from:
- Your misuse of the service;
- Your breach of these Terms;
- Your unlawful processing of customer data;
- Content submitted through your account.
15. Termination
TradeOp may suspend or terminate access where:
- These Terms are breached;
- Payment is overdue;
- The service is used unlawfully;
- Continued access presents a security risk.
Customers may terminate their subscription in accordance with their subscription agreement.
16. Privacy
Your use of the service is also governed by our Privacy Policy.
Where personal data is processed, both parties agree to comply with all applicable data protection legislation.
17. No Warranty
The service is provided “as is” and “as available”.
TradeOp makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose or non-infringement.
18. Force Majeure
TradeOp shall not be liable for any delay or failure to perform resulting from events beyond its reasonable control including natural disasters, internet outages, telecommunications failures, cyber attacks, strikes, acts of government or failures of third-party providers.
19. Changes to These Terms
We may amend these Terms from time to time.
Continued use of the service following publication of updated Terms constitutes acceptance of those changes.
20. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
